Understanding Child Support
Basic child support in a sole custody case is a regular payment made by one parent to cover the expenses of a child who is living with the other parent. In a joint custody situation, parents share the costs. How much each pays is based on a formula that takes into account each person’s income and the amount of time the child spends with each parent.
We will represent you in Family Court with filing or defending against child support petitions. If necessary, our firm will advocate for you in the Supreme Court. We know the New York and New Jersey support guidelines so you can be confident that all proposed child support orders will be in compliance.
Manhattan and Queens Spousal Support Lawyer
One key element in many divorces or legal separations is the issue of spousal support. The courts can award this monetary payment to one spouse from the other based on many factors such as:
- The length of the marriage
- Each person’s occupation and income
- The health and age of each person
- Assets held and debts owed
- The potential future income of each person
The new New York State law (effective since October of 2010) applies a formula to calculate temporary spousal maintenance for a party who needs the help. Ideally, the couple can reach a positive result through negotiating with each other a fair amount and duration of maintenance in a safe and productive environment. If you choose to mediate, we will provide the guidance of an experienced neutral professional to help you reach the best solution in the most cost-effective process. If mediation is not possible, we can represent you in court.
